Terms of Service
Last updated: 2026-10-18 · Beta
These Terms are an agreement between you and LevelUp ("Persony", "we", "us"), the operator of the Persony apps and websites (the "Service"). Contact: support@persony.org.
By creating an account you confirm that you have read and accept these Terms, our Privacy Notice, our Safety page and our Community Guidelines. If you do not accept them, do not use the Service.
1. Who can use Persony
- You must be 18 or older. Persony is not intended for anyone under 18.
- You may not use the Service if you are barred from receiving it under applicable sanctions.
- Keep your sign-in secure. You are responsible for activity in your account. Tell us at support@persony.org if you suspect misuse.
2. What Persony is — and is not
- Persony lets you talk by text and voice with AI personas — characters generated by artificial intelligence. Personas are not people. They cannot feel emotions, they know about you only what you tell them, and they have no professional qualifications.
- No professional advice. Nothing a persona says is medical, mental-health, legal, financial or other professional advice, even when a persona is presented as a coach, nutritionist, listener or expert. Check important decisions with a qualified professional.
- Not an emergency service. Persony cannot help in an emergency and does not monitor conversations in real time. If you or someone else is in danger, contact local emergency services or a crisis line — see the Safety page.
- AI makes mistakes. Replies, memories, transcripts, voices and images are generated automatically and can be wrong, incomplete or inappropriate. You decide how to use them.
- Personas that write first. Some personas send you messages on a schedule. You see and change these in each chat ("Regular messages") and can turn them off at any time. Push notifications are sent only if you enable them on your device.
- Beta. The Service is an early version. Features, personas and limits may change, and data loss is possible. Keep your own copy of anything important (you can download your data in Settings).
3. Your content
- "Your content" means what you put into Persony: messages, voice recordings, personas you create (names, descriptions, characters, images) and other material.
- You keep ownership of your content. You allow us to host, store, process, transmit, display and adapt it only to operate, protect and improve the Service, including sending it to the providers listed in the Privacy Notice.
- Public and shared personas. If you make a persona public or share its link, you also allow us and other users to view it, talk to it and make their own copy ("remix") within Persony. You can make it private again at any time; copies other users already made may remain.
- You confirm that you have the rights to your content and that it does not break the law, these Terms or the Community Guidelines.
- AI output. As between you and us, you may use the AI output you receive for any lawful purpose. Similar output may be given to other users.
4. Rules of use
You agree to follow the Community Guidelines. In particular, you must not use Persony to: break the law; create sexual content involving minors or any sexually explicit content; harass, threaten or encourage self-harm or violence; impersonate real people or mislead others into thinking they are talking to a real person or organization; infringe copyrights or trademarks (for example by publishing copyrighted characters); upload other people's personal data without a right to do so; send spam or malware; or scrape, overload, reverse-engineer or bypass the limits or security of the Service.
We may remove content, limit features, suspend or close accounts that break these rules, and report illegal content to the authorities where the law requires.
5. Reporting content
Report a persona, image or behaviour you believe is illegal or breaks these Terms by writing to support@persony.org with the link and the reason. We review reports, may act on them, and explain our decision to the reporter and the affected user where the law requires. Copyright complaints go to the same address and should identify the work and the infringing content.
6. Free allowance and paid plans
- Free allowance. Every account gets a free allowance of messages and voice minutes, shown in Settings → Plan & Usage. It does not expire by time; when it is used up, your personas, chats and memories stay available, and you can upgrade to continue talking.
- Plus. The paid plan is a subscription sold by Paddle.com, our merchant of record, monthly or yearly. The price, taxes, renewal and cancellation terms are shown before you pay. It renews automatically until you cancel; after cancelling you keep Plus until the end of the period you paid for. Plus also has fair-use limits on messages, voice minutes and processing, shown in Plan & Usage.
- Refunds follow our Refund and Cancellation Policy.
- We may change allowances, limits and prices for future periods; we will tell you before a price change applies to your subscription.
- If we introduce invites or rewards for recommending Persony, their rules will be shown before you take part.
7. Changes and ending the service
- We will tell you about material changes to these Terms in the app before they take effect and ask you to accept them again. Changes required by law or for safety may take effect immediately.
- You can stop using Persony at any time and delete your account in Settings; deletion removes your personas, chats and memories.
- We may suspend or end your access if you break these Terms, if the law requires it, or if we stop the Service. Where reasonable we will warn you and give you a chance to download your data.
8. No warranties
To the maximum extent permitted by law, the Service and all AI output are provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose, accuracy and non-infringement.
9. Limitation of liability
- To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill, arising from the Service, AI output, or other users' content or conduct.
- Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and USD 50.
- Nothing in these Terms limits liability that cannot be limited by law — including for death or personal injury caused by negligence, fraud, gross negligence or intentional misconduct — and nothing affects your mandatory rights as a consumer under the law of the country where you live.
10. Your responsibility to us
If you break these Terms or the law and a third party makes a claim against us because of it, you will compensate us for the resulting reasonable losses and costs, to the extent the law allows and the breach was your fault.
11. Law and disputes
- These Terms are governed by the law of the country where LevelUp is registered. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence.
- Please write to support@persony.org first; we will try to resolve the issue within 30 days.
- The competent courts at LevelUp’s place of registration have jurisdiction; as a consumer you may also bring a claim in the courts where you live.
12. Other terms
If a provision is unenforceable, the rest remains in force. We may transfer these Terms to a successor of the Service; you may not transfer them without our consent. Not enforcing a provision is not a waiver. These Terms, the Privacy Notice, the Safety page and the Community Guidelines are the whole agreement on this subject. If a translation differs from the English version, the English version prevails to the extent the law allows.
